UNedited scan of the letter I recieved today. Keep in mind, the accident happened December 7th, at 3:04PM. Look at the date Stated. This was a CC of what was sent to the other policy holder

DATE OF LOSS: December 7, 2002

Dear Ms. Twigg:

We have completed our investigation into coverage for the above captioned loss.

Our investigation reveals that your policy was cancelled due to a non-payment of premium effective December 7, 2002 at 12:01 am.

Based on the above, we must respectfully deny coverage for this loss. Please contact me if you have any further documentation for us to consider in this matter. At this time, all interested parties will be referred to you.

Even though there is no coverage for this loss, under some circumstances the company can still have a duty to defend you against a lawsuit filed by another party damaged in this loss. Because of this, it is important that you promptly notify the Company of any lawsuit that is served on you by any other party involved in this loss. Should you receive any material by mail, or in person, please note the date and method of service on a separate piece of paper. Attach it to the lawsuit and forward it immediately to this office for review and determination on this issue.

you have no choice sue her, its a pain but it has to be done, no insurance she was at fault at 12:02 pm its against the law to be on road with out insurance in calif, so she is at fault from get go.open shut case. sue her for time down too ..

You knew from the begining you were in for a ride Matt. Hang in there and follow and enforce the law to its fullest, either that or we can go down there with a baseball bat for you and brake some shins...your call!

As Manny said you have no choice but to go after the registered owner and/or driver now. Nobody likes that kind of stuff but go get yourself an aumbulance chaser (sorry to all you 'personal injury attorneys' out there) and look around for one with a good track record and go get'em. When that's all finished we can go to Al's #2 plan if need be.

Presuming that you have uninsured motorist coverage Matt....you now deal with your own insurance as they step in and cover your loss. They then go and subrrogate the claim against the other driver.
Sometimes dealing with your own insurance company is easier that with the other guy's insurance anyway.
