Ok, well like 3 -4 months ago, i was pulled over for speeding :(, apart from that i didnt have insurance, my dad got it in the morning but didnt tell me it was on the dresser, so i didnt have it in the car, well CHP takes my car for not having insurance for a day. Well i went to court today and i pleaded guilty to all charges, and bam, here comes the surprise, guess how much i have to pay? anyone wanna take a shot at it.

well first you tqake your proof of insurance that it was in fact inssured on that day to court so you dont have to pay that fine. other then that. i would say $120max.

ha not even close, anyone else, the judge said, u were caught driving with out insurance at the time.

How about $2500 USD?!

Up here in Ontario, if you get nabbed for driving without insurance, the first offense fine can go as high as $5000 CAD!!!

...Although, in your case, were you really driving without insurance, or just driving without proof of insurance? When did the policy kick in?

If you just didn't have proof of insurance on you, then you should have been able to take your insurance slip in and have the fine cut back significantly, if not ripped up completely.

i agree- lawyers are a little costly, but mine has gotten me out of a couple tickets and in the long run has saved me lotsa moolah

I got busted for the same thing the day I came back for Saudi...I'm talking about 3 hours after I arrived at the Colorado Springs airport...My fine was $400 and 40 hours community service.

yeah man my fine is $1336.00 i need to pay them by SEPT 13 2004, that means 3 months man, its like making 3 payments on a new car.

I still don't understand why, if you had insurance, that your fine could be that much, and why you would plee guilty???

Mabe I am missing something.

i'm not quite sure on the laws in CA, but if you were driving w/o insurance then u are screwed. If it's just no proof of insurance, then you should be able to get that ripped up.

i told him i had it it but it was at home, he repeated to me again, u were caught at the moment with no insurance, im like ohh ok,

You need to appeal it. You did have insurance. Period. If you were in an accident, you were covered. Call a couple attornys that offer free consultations and explain to them what happend and they can still help you out.

I know that here in Sacramento if you get a ticket and go to court and they fine you $100, it goes up on top of that. First, you have the $100 fine, then you have a %150 PENALTY on top of the $100 fine. Now its up to $250. Then if you dont have the $250, you have to make payment arrangements. Thats a $35 administrative fee. Plus $10 for getting the ticket, plus a $7 night court fee even though you went to court at 8:30am and took time off work to do it. YOu are over $300 for a ticket that has a fine of $100. Now, this is in Sacramento County. I was pulled over in a neightboring County (Placer County) and recieved a ticket for crossing a double yellow and was fined $100. After all was said and done, I paid....get this.... $100. Each county is different, but get a lawyer and research the laws that you SUPPOSEDLY broke. You'll be amazed at what you get a ticket for that is actually not illegal. Like driveing barefoot. My mother in law recieved a ticket for it, yet talking to my attorney, its not illegal. Or at least here its not....yet.

You got a BONE HEAD judge.

You had insurance, you just didn't have the piece of paper on you.
That piece of paper will prove that, "at the moment you were caught", you did in fact have insurance.

You went to court for a driving without proof of insurance violation and didn't bring any insurance documents proving that you were insured? :confused:

No offense but, you really need to find a lawyer to help you with this stuff.

Ok this is the part i left out, As my name was being called, the sherrif called me and asked for my insurance, i ran back to the car and got it, since the car is registered to my dad the insurance was in his name too, the sherriff says THE INSURANCE has to be under ur name, im like well i cant because the car isnt under my name, and she says oh ok i should of told u before u left, As the judge calls me, i told him that the car had insurance and all he said and repeated, you were caught driving without insurance at the time. I was like ok man.

The day I brought home my 90 xr7, we got pinched about a block from the house. My friend got a no INS. ticket, along with a few others. Title was still in the other persons name, technically, wasn't even my car yet. In court, my moms name was on the policy for the 95sc, even though the insurance is in my name. He said "who's adrienne?, your wife?" Nope, my mom. He told me then that I wasn't insured. I told hime I pay for the car, insurance, gas, and matinence, I'm insured. He asked what my mom thought of the ticket. I told hime she thought it was the dumbest friggin thing she'd ever heard of. I also mentioned that If he wanted to speak to her personally, continue the case, and I'd run home and bring her there. All was dropped on that account.

So many you should have's. Not pointed at you but for those following along.

#1 - It's a given that a Lawyer may have been helpful.
#2 - If the car is titled in your parent's name, and insured by them, you should have had your parents (or the owner of the vehicle if not your parents) come to court with proof of insurance. Liability insurance follows the car, not the person driving. At least that is the case in most states. Some states don't even require insurance. So the law depends on the state.

Note that what the insurance company requires may be completely different. Most insurance companies are going to require a parent to add their child to their policy. Thus they calculate a higher rate. If a child isn't added to a policy, the insurance company may be forced by law to take care of anyone you hit, but they may not be required to do anything for you or your parent's car.
